well he called me this morning and apologized about the way he has been handling this situation. He said that he had some fraudulent activity in his account and basically he doesn't have the money. Obviously looking at it from my point he agreed it looked bad. I told him he should have been straight with me and just told me he didnt have the money etc. He said he was hoping to have everything straightened out and a check to me but the funds were never there. He said he should be able to send something out by the end of the week.  He sounded sincere so we will see.

Just wanted to update you guys on the situation.

Seb sounds like to me he is about to go belly up/bankrupt and is using the supposed fraudulent activity as a cover to not send you the money. I will be VERY surprised if you ever see a dime back from him. I would make him send me some off the shelf wheels or something that you could sell to make up for the money.

Excuse, after excuse, after excuse. This guy is going to keep making up shit for reasons not to send you the cash back. When you talk to him next, the conversation has to be something on the line of...

"Okay, I understand what you are saying. But like a bank doesn't care too much about excuses, neither do I. The bank can foreclose. I, can put you in jail and/or ruin you financially. What is your definative date that you'll have the cashier's check, along with a valid tracking number, to be sent out?"

"Great. So, you understand, that 1 week after this agree'd upon date, if nothing has arrived, I will be taking you to court, and having our attorney's contact you to put a lien on you. You already gave me a tracking number once, and it was an outright lie as it didn't exist. I have Non Union/Good friend of the Union person who is in Cali that may be able to help...let me know.

I also have a friend that has a debt collection business....if he has everybody in the office call for a few days....the guy may need therapy...there ruthless..."Your not man enough to pay your bills"  "Your neighbor Mr $#@$#@ said that he is really surprised about this because you seem like a nice guy"  Then they check all his CCards and notify all his vendors that he does business with that they better get cash payment up front.....etc etc.....

Actually owning up and saying shit isnt' flying, is another matter, and I gotta respect for that.  Still doesn't mean he hasn't fucked it up, but he's manning up.  Beats the fuck out of a lotta deadbeats out there. 

So he's a semi-honest assohole..  Still and asshole, though.

I think its time to take this to the next step, take every email, every receipt, and go get a lawyer.  Do NOT threaten him, he doesn't have much of a case for himself, so don't give him one.

The court stuff takes a long time, my truck was vandalized when i was in highschool, the guy told a bunch of people he was going to do it, (it was home coming, and allot of people go around pulling pranks on eachother). he also had three felony's on his record and was not yet 18.  He took all the lugnuts of my rear passenger tire, and the tire came off in the parking lot, causing $2,300 in body damage to my truck, and also twisted the frame. I had bought it a month earlier.
i went with the county attorney, bad idea, he got his own lawyer, my guy didn't really care about the case, never told me what was going on, and 6 months later when we finally go to court. his lawyer had 2 witnesses that the county attorney approved of, what do you know they are both his friends, and one even said that i offered them $50 to testify against there friend. and his lawyer started asking me questions like where were you, and did you ever pay some one to remove your lugnuts, and how do we know you were at the game.  my answer was because i played, and then he asks but did you play the whole time.  long ass story short, he got off, cuz they said it was all circumstantial evidence.

basically all i can say is get your own lawyer, a good one is well worth it.  but be ready for 6 to 8 months of bullshit.

Well its been a whole month of me giving him time and last week he lied to me again. He told me "check is going out today". I told him I have no problem as long as he doesnt lie to me. Well he obviously doesnt give a rats ass as he lied without even missing a beat. Ive been very patient with him this whole time. Im done.

He has shown everybody what his company is about.

This guy has no intention of paying you back. He'll just keep saying check is in the mail for the rest of eternity. Something needs to be done. What are our options? Court? A bunch of us all head down there? Get a small posse to escort him to the bank, get a cashier's check made out to Seb's full name? Go down there, and if he doesn't have any money, say "Ok, if you don't mind, we'll just take $2100 worth of stuff since you owe that to him.

Regardless, and attorney needs to be consulted immediately.

Btw, exactly what kind of wheels did you order in the first place?
